2.1. Agreement to Terms
By accessing or using DeFi-Freelance.uno ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you are prohibited from using the Platform.
2.2. Definitions
"Platform" refers to the website DeFi-Freelance.uno and its services.
"User," "You," "Your" refers to any individual or entity accessing the Platform.
"Client" refers to a User who posts a project and hires Freelancers.
"Freelancer" refers to a User who offers and provides services to Clients.
"Service" refers to the freelance work contracted between a Client and a Freelancer.
"BTCPay Server" refers to the third-party payment processor integrated into the Platform for handling all financial transactions.
2.3. User Accounts
You are responsible for maintaining the confidentiality of your account information and password.
You are responsible for all activities that occur under your account.
You must be at least 18 years old to use the Platform.
2.4. Services and Contracts
The Platform is a venue to connect Clients and Freelancers. The Platform is not a party to the service contract between Clients and Freelancers.
Clients and Freelancers are solely responsible for defining the scope of work, deliverables, timelines, and communication.
The Platform provides an escrow service via BTCPay Server to facilitate secure payments. Funds are held in escrow by BTCPay Server until the Client approves the work.
2.5. Financial Terms
Fees: The Platform charges a service fee on each transaction. The specific fee structure will be clearly displayed before a bid is placed or a project is funded.
Payment Processing: All payments are processed exclusively through BTCPay Server. You agree to be bound by BTCPay Server's terms in relation to the processing of transactions.
Cryptocurrency Volatility: You acknowledge that the value of cryptocurrency (e.g., Bitcoin) can fluctuate rapidly. The Platform and BTCPay Server are not responsible for any gains or losses in value between the time a transaction is initiated and completed.
Refunds and Disputes: Disputes regarding the quality or delivery of service should first be resolved directly between the Client and Freelancer. If a resolution cannot be reached, users may contact Platform support for mediation. All decisions made by the Platform in mediation are final.
2.6. User Conduct and Prohibited Uses
You agree not to use the Platform to:
Violate any applicable law or regulation.
Post false, inaccurate, or misleading information.
Infringe upon any copyright, patent, trademark, or other intellectual property rights.
Transmit spam, chain letters, or other unsolicited email.
Circumvent the Platform's payment system.
Distribute viruses or any other technologies that may harm the Platform or its users.
2.7. Intellectual Property
Clients retain ownership of any intellectual property they own before starting a project.
Upon full payment and completion of a project, the Freelancer typically assigns all rights to the work product to the Client, as defined in their service agreement. The Platform is not responsible for drafting or enforcing these agreements.
2.8. Disclaimer of Warranties & Limitation of Liability
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND. WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM.
2.9. Termination
We may suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.
2.10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of USA, without regard to its conflict of law provisions.
